As described in the Governing Documents, CCR’s Section 3.33, pages 22 -24, Solera at Johnson Ranch is an over 55 age restricted community. Section 3.33.2 of the CC&R’s gives the Board of Directors the authority, but not the obligation to approve a written request to waive these rules and permit someone under 55 to purchase or lease a home at Solera. The CC&R’s permit up to 20% of residential units in the HOA to be occupied by persons under 55.
Be aware that if you are considering buying a home in Solera and need to request this waiver there is a very important issue of timing. The policy of the Board of Directors is to only consider these waiver requests in open session at a duly called Board of Directors Meeting. The meetings are held on the third Thursday of each month and the completed waiver request must be received by the community manager no later than the Friday before the meeting date.
